The claimant was a joiner who was
using a jig saw to cut a large piece of wood whilst on a building site. He
used a saw provided by his employer but one that he knew had a few faults.
The faults had not been fixed
despite other workers having reported the defects to the employer through
the line manager.
The claimant was injure when the
saw (which had a defective blade) spun round digging into the wood and
struck him on the wrist. He suffered a colles fracture and ligament damage.

Provision and Use of
Work Equipment Regulations 1998 apply to all types of machinery,
apparatus, and tools that are used at work. The aim of these Regulations is
to ensure the provision of safe work equipment and its safe use. In this
case the employer was in breach of the duties laid down by this legislation.
The claimant succeeded in his
claim and won £7500 in compensation by using our service. Legal costs were
