personal injuries through lack of Personal Protective Equipment (PPE's) at work

In some working environments it may be imperative that protective equipment be provided such as safety footwear, safety hats, high visibility vests and jackets, gloves and eye protectors.

According to the Health & Safety Executive   - PPE is defined in the Regulations as ‘all equipment (including clothing affording protection against the weather) which is intended to be worn or held by a person at work and which protects him against one or more risks to his health or safety’, eg safety helmets, gloves, eye protection, high visibility clothing, safety footwear and safety harnesses.

The supply of inadequate protection or indeed no protection at all will increase the chances of personal injury in certain jobs. If you have been injured through a lack of protective equipment or because of poorly maintained equipment then you may be able to claim compensation.

To improve safety in the workplace and minimise the risk of injury the Personal Protective Equipment at Work Regulations 1992 were brought into force.

These ensure that employers ensure that suitable personal protective equipment (PPE) is provided to those that require it. The PPE provided must be appropriate for the risk involves, it capable of correct fitting and is effective to prevent or control risk, and it should also take into account ergonomic requirements and the health of those that must wear it.

An assessment should be made to ensure the equipments suitability and that it is maintained in good working order and repair. Training and information should also be provided to the employees so that they are aware of the risks that having PPE will limit or avoid what the actual purpose of the PPE is and what they need to do to ensure the efficient working order of the PPE.
