The Work at Height Regulations
2005 are
applicable to builders and scaffolders but can also include
shop assistants who may have to climb ladders to stock shelves or
decorators, office based staff and many other workers.

Case study - accidents with
ladders
The claimant in this case was working
on a platform 12 feet from the ground. He was decorating the outside of a
building when a co-worker removed his ladders and left the claimant with no safe
means to negotiate his way down to the ground
The claimant fell as he climbed down
and fractured his shoulder and foot. The workers in the team had only 1 ladder
between 6 of them and all were working in different locations on the site. The
employer had failed to provide enough ladders for the number of workers involved
in the job and this led to people "borrowing" the ladder at various stages
during the day.
The claimant won his claim despite an
argument against him that he contributed significantly to the incident by
clambering down when it was unsafe to do so. He was awarded £12,000 in
compensation for injury and loss.
The case did not involve court
proceedings
